1. Introduction

Welcome to MyTree, a family-focused digital platform operated by Legacy AI Technologies (OPC) Private Limited ("MyTree", "we", "us", or "our").

These Terms & Conditions ("Terms") govern your access to and use of the MyTree website, application and related services (collectively, the "Services").

By accessing, registering for, or using the Services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Services.

2. Eligibility

You must be legally capable of entering into a binding agreement under applicable law to use the Services.

If you use MyTree on behalf of another person, including a family member or organisation, you confirm that you have the authority to do so.

Where the Services involve children or information relating to children, use should be undertaken with appropriate parental or guardian involvement and in accordance with applicable law.

3. Creating an Account

Certain MyTree features may require you to create an account.

You agree to:

• Provide accurate and current information;
• Keep your account information updated;
• Maintain the confidentiality of your account credentials and OTPs;
• Not share your account or authentication credentials with unauthorised persons; and
• Immediately notify us if you believe your account has been compromised.

You are responsible for activity carried out through your account, except where such activity results from circumstances beyond your reasonable control.

4. Family Trees and Family Information

MyTree allows users to create and maintain family trees and connect with family members.

Information contained within a family tree may be entered by different users and may not always be accurate, complete or verified.

MyTree does not independently verify:

• Family relationships;
• Dates of birth;
• Names;
• Family history;
• Ancestry information;
• Photographs;
• Personal information; or
• Other information entered by users.

You are responsible for ensuring that information you add is accurate and that you have an appropriate basis or permission to add information relating to another person.

5. User Content and Memories

MyTree may allow you to create, upload, store or share content including:

• Photographs;
• Videos;
• Audio or voice recordings;
• Text;
• Family stories;
• Personal memories;
• Documents; and
• Other materials ("User Content").

You retain ownership of User Content that you have the legal right to own.

By uploading or submitting User Content to MyTree, you grant us a limited, non-exclusive, worldwide licence to host, store, reproduce, transmit, display and technically process that content solely as necessary to provide, operate, maintain and improve the Services.

We do not acquire ownership of your User Content merely because you use MyTree.

6. Your Responsibility for User Content

You are solely responsible for the User Content that you upload, create or share.

You must not upload or share content that:

• You do not have the right or permission to use;
• Infringes another person's copyright, trademark, privacy or other rights;
• Is unlawful, fraudulent, defamatory or misleading;
• Contains malicious software or harmful code;
• Is threatening, abusive, harassing or discriminatory;
• Violates applicable law;
• Contains another person's personal information without an appropriate basis or permission; or
• Is otherwise inappropriate for the intended family-oriented nature of MyTree.

You should obtain appropriate permission before uploading photographs, recordings, documents or other personal material relating to another person.

7. Family Sharing and Privacy Settings

MyTree may provide different sharing or privacy settings for User Content.

You are responsible for selecting the appropriate privacy or sharing setting before sharing content.

Content shared with family members or other users may be viewed, copied, downloaded, recorded or redistributed by those users, depending on the functionality available.

Accordingly, you should carefully consider what you choose to share and with whom you share it.

We cannot guarantee that information intentionally shared with another user will remain confidential after that user has received access to it.

8. Messaging and Communications

MyTree may provide personal or family group communication features.

You agree to use these features responsibly and not to:

• Harass or threaten other users;
• Send spam or unsolicited promotional messages;
• Impersonate another person;
• Distribute unlawful or harmful content;
• Attempt to access another person's account; or
• Use the communication features for fraudulent or abusive purposes.

We may take appropriate action where we become aware of misuse of the Services.

9. Prohibited Activities

You agree not to:

• Use MyTree for unlawful purposes;
• Attempt to gain unauthorised access to the Services or another user's account;
• Reverse engineer, decompile or otherwise attempt to extract the source code of the Services, except where permitted by law;
• Interfere with or disrupt the operation of MyTree;
• Circumvent security or access controls;
• Use automated systems to scrape or collect information from MyTree without permission;
• Upload malicious code or files;
• Misrepresent your identity;
• Use MyTree to conduct fraudulent activities; or
• Exploit the Services for purposes other than their intended use.

10. Intellectual Property

The MyTree name, logo, branding, website design, software, graphics, text, interfaces, functionality and other materials provided by us are owned by or licensed to Legacy AI Technologies (OPC) Private Limited and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not:

• Copy;
• Modify;
• Reproduce;
• Distribute;
• Sell;
• License;
• Create derivative works from; or
• Commercially exploit

our intellectual property without our prior written permission.

11. User Feedback

If you voluntarily provide suggestions, ideas, feedback or recommendations regarding MyTree, you agree that we may use such feedback to improve our Services without owing you compensation, provided that doing so does not disclose your confidential personal information.

12. Third-Party Services

MyTree may rely on third-party services, platforms or infrastructure to operate certain aspects of the Services.

These may include cloud storage, authentication, notification, analytics, payment, communications or other technology providers.

Your use of third-party services may also be subject to their own terms and policies.

We are not responsible for the independent acts, omissions, availability or policies of third-party service providers.

13. Service Availability

We aim to keep MyTree available and reliable, but we do not guarantee that the Services will always be:

• Free from technical defects.

The Services may occasionally be unavailable because of maintenance, upgrades, technical problems, security incidents, network failures or circumstances beyond our reasonable control.

14. Changes to the Services

We may also introduce new features or services that may be subject to additional terms.

We will make reasonable efforts to communicate material changes where appropriate.

15. Account Suspension and Termination

We may suspend or terminate your access to MyTree where we reasonably believe that:

• You have violated these Terms;
• You have used the Services unlawfully;
• Your account poses a security risk;
• Your activity may harm other users or the Services; or
• Suspension or termination is required by law.

You may stop using MyTree at any time and may request deletion of your account in accordance with our Privacy Policy and available account functionality.

Termination of an account may not automatically remove information that has been legitimately shared with other family members or information that must be retained for legal, security or operational reasons.

16. Deletion of User Content

Where functionality is provided, you may delete individual User Content or request deletion of your account.

However, deletion may not immediately remove:

• Copies retained for legitimate technical or security purposes;
• Information that must be retained by law;
• Content that has already been shared with other users; or
• Information forming part of another user's family tree or account.

We will handle deletion requests in accordance with applicable law and our Privacy Policy.

17. Disclaimer

MyTree is intended to provide a platform for families to connect, communicate and preserve memories.

We do not guarantee the accuracy or authenticity of information uploaded by users.

We are not responsible for:

• The accuracy of family-tree information entered by users;
• The authenticity of memories or stories;
• Disputes between family members;
• Content uploaded by users;
• Actions taken by other users based on information available through MyTree; or
• Loss resulting from a user's failure to maintain appropriate copies of important personal content.

You are encouraged to maintain your own copies of important photographs, recordings, documents and memories.

18. Limitation of Liability

To the maximum extent permitted by applicable law, Legacy AI Technologies (OPC) Private Limited and its directors, employees, contractors and service providers shall not be liable for indirect, incidental, special, consequential or punitive damages arising from or relating to your use of the Services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

19. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Legacy AI Technologies (OPC) Private Limited, its directors, employees and service providers from claims, losses, liabilities, damages and reasonable expenses arising from:

• Your violation of these Terms;
• Your misuse of the Services;
• Your User Content;
• Your violation of another person's rights; or
• Your violation of applicable law.

20. Privacy

Your use of MyTree is also governed by our Privacy Policy, which explains how we collect, use, store and protect personal information.

Our Privacy Policy forms part of these Terms.

21. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable law, disputes arising from or relating to these Terms or the Services shall be subject to the jurisdiction of the courts in India.

22. Changes to these Terms

We may update these Terms from time to time.

When we make material changes, we may provide appropriate notice through the website, application or other available communication channels.

Your continued use of MyTree after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
